Terms of Service

These Terms of Service ("Terms") govern your access to and use of TestPilot ("Service"), operated by Sana Ventures Studio SL ("Company", "we", "us", or "our"), a company registered in Spain. By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using TestPilot in any way, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Authorized Use — Critical

Unauthorized testing of third-party applications, systems, or infrastructure is strictly prohibited and may constitute a criminal offense under applicable law, including but not limited to:

• Spain: Ley Orgánica 10/1995 (Código Penal), Articles 197 and 264
• EU: Directive 2013/40/EU on attacks against information systems
• International: Computer Fraud and Abuse Act (CFAA) and equivalent legislation

By using TestPilot, you represent and warrant that you have full legal authority to test each application you submit to the Service. You must be able to demonstrate this authorization upon request.

3. Prohibited Activities

You agree not to use TestPilot to:

• Test any application, system, or network without explicit written owner authorization
• Use test results, security findings, or vulnerability reports to exploit, attack, or gain unauthorized access to any system
• Conduct denial-of-service attacks or automated abuse of third-party systems
• Extract, scrape, or collect data from third-party applications without authorization
• Violate any applicable law, regulation, or third-party rights
• Attempt to circumvent, disable, or interfere with security features of the Service
• Share, sell, or distribute security findings obtained through the Service for malicious purposes
• Use the Service to harm, harass, or defraud any person or organization

4. User Responsibility and Indemnification

You are solely and entirely responsible for:

• All activities conducted through your account
• Ensuring you have legal authorization to test each application
• Any consequences arising from the use or misuse of test results
• Compliance with all applicable laws and regulations in your jurisdiction
• Any damage, loss, or liability caused to third parties through your use of the Service

You agree to indemnify, defend, and hold harmless Sana Ventures Studio SL, its directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any unauthorized testing conducted through your account.

5. Bring Your Own Key (BYOK)

TestPilot operates on a Bring Your Own Key model. You connect your own Anthropic API key to power AI-driven testing. You are solely responsible for:

• All costs incurred through your Anthropic API key
• Keeping your API key secure and confidential
• Any unauthorized use of your API key

TestPilot stores your API key exclusively in your browser's local storage and never transmits it to our servers except as required to execute test requests. We are not responsible for any charges incurred on your Anthropic account.

6. Free Test Run

New users may receive one complimentary test run funded by the Company. This free run is limited to 100 words in the test scenario description, is provided at our sole discretion, may be withdrawn at any time, and is subject to fair use. Abuse of the free run (including creating multiple accounts to obtain additional free runs) will result in immediate account termination.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Test results will be accurate, complete, or suitable for any purpose
• Security scans will identify all vulnerabilities in tested applications
• The Service will meet your specific requirements

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SANA VENTURES STUDIO SL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or €100, whichever is greater.

9. Security Testing Disclaimer

TestPilot's security scanning features are designed to help application owners identify vulnerabilities in their own systems. Security findings are provided for informational purposes only. We expressly disclaim any liability for:

• Security vulnerabilities not detected by the Service
• False positives or inaccurate vulnerability assessments
• Any damages resulting from acting upon or failing to act upon test results
• Any breach, attack, or unauthorized access to any system

10. Account Termination

We reserve the right to suspend or terminate your account immediately, without notice, if we reasonably believe you have violated these Terms, engaged in unauthorized testing, or used the Service for any illegal or harmful purpose. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may update these Terms from time to time. When we do, we will update the version number and effective date above, and require you to re-accept the updated Terms before continuing to use the Service. Continued use after acceptance constitutes agreement to the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
